A. Policy - Allowance Before 1/6/86

Set a MINE diary at CDR for cases initially allowed before January 6, 1986, under Listing 5.05A/B.

NOTE: Since language in the previous Listing 5.05A/B did not limit the presumption of disability to 3 years, a finding of medical improvement related to the ability to work is not possible under the MIRS.

B. Policy - Allowance 1/6/86 to 12/17/07

For cases initially allowed on or after January 6, 1986, through December 17, 2007, under Listing 5.05 A/B, set a MIE diary, if a MIE criterion is met.

C. Policy - Allowance 12/18/07 or Later

For cases initially allowed on or after December 18, 2007, under Listing 5.05A or 105.05A, set a MIE diary.
