RS 01301: Living With, Contributions and One-Half Support

A. POLICY - WHEN PROOF MUST BE FILED

1. General

For spouse's, surviving spouse's, and parent's benefits, proof of support must generally be furnished within 2 years after the point in time at which the support requirement is met.

2. NH Deceased

Proof of support must be filed within 2 years of the date of the NH's death.

3. NH Entitled to RIB or DIB

Proof of support must be filed within 2 years of the month in which the NH becomes entitled to an RIB or DIB, or (where the support requirement is to be met as of the beginning of a period of disability) within 2 years of the month the NH filed an effective application for the period of disability.

4. Cases Involving GPO

Good cause for failure to file proof of support timely will be deemed to be met (see GN 02608.104).

B. POLICY - ADDITIONAL PROOF NEEDED AFTER SUPPORT FILED

The requirement is met if some proof of support is filed before the end of the 2-year period even though further proof may be needed.
