GN 02610: Title II/Title XVI (Windfall) Offset

A. INTRODUCTION

After computing title II offset for a couple using the couple's SSI rate per GN 02610.035, determine the fraction of each member's retroactive benefits in the offset period to the couple's total retroactive benefits to compute the individual's share of the offset amount.

B. EXAMPLE

John Allen has been receiving SSI benefits of $368.00 for some time. His MOET to title II of $250.00 per month is 01/89 (due 02/89). He receives his first title II benefit in 05/89. Ann Allen is entitled to $600.00 title II in December 1988 (due in 01/89). Her CMA is paid in 05/89. She is determined eligible for SSI benefits in January as a member of an eligible couple.

  • Title II offset applies because John has been receiving SSI for some time.

  • Ann's retroactive SSI benefits of $185.00 per month for January through April are released without reduction.

C. PROCEDURE

To compute the title II offset for each member of the couple, the FO must:

Enter monthly title II benefits for each month of the offset period on a separate SSA-4968 for each member using couple's SSI rates where applicable.

Compute SSI that is due for each month counting the title II benefits paid when due.

Subtract results of step 4 from the SSI that was due on the SSR (SSID FAM) for each month.

RESULT: This amount is the offset amount. (FOA)

NOTE: None of the SSI would have been due if the title II had been paid when due.

Follow steps 5 and 6 to compute the State offset amount if a State supplementation is involved.

Enter results in column 4 or 5 on SSA-4346-U2 following rules in step 6.

Determine each individual's prorated share of the total retroactive title II due by dividing each person's retroactive title II benefits by the total.

Complete Section II of the SSA- 4345-U2. Prepare two forms when both members are entitled on the same title II claim and annotate “Couple's case - offset prorated.”

Post offset results to SSR. If unable to post or PC initiated the request for the computation,

  • Call PC with offset results.

  • Send original worksheets to the PC annotated “prong file.”

The PC will:

  • Record the data from Section II of SSA-4345-U2.

  • Post data to the MBR.

  • Subtract offset from the retroactive title II benefits.

  • Subtract any collectible SSI overpayment - see SI 02220.021.

  • Release any remaining title II benefits due each member.
